Broughton in Amounderness Pre-submission Neighbourhood Plan Regulation 14 Consultation
Broughton In Amounderness Parish Council are currently in the process of reviewing the Made Broughton in Amounderness Neighbourhood Development Plan which was originally Made by Preston City Council following a positive Referendum on 18 October 2018.
Regulation 14 of the Neighbourhood Planning (General) Regulations 2012 (as amended) requires the Parish Council, as the Qualifying Body, to undertake a period of consultation for a minimum of 6 weeks.
The consultation period will run from 9am Friday 29 November to 5pm Friday 17 January 2025.
Copies of the Broughton In Amounderness Pre-submission Neighbourhood Plan and its associated supporting documents are available to view either online on the Broughton Parish Council web page or in-person upon request during normal office hours at the Parish Council Offices.
Comments and clarifying questions are invited.

Made Plan - 2018
Following a positive referendum result on 18 October 2018, Preston City Council has made the Adopted Broughton Neighbourhood Plan (PDF, 8 MB) part of the Development Plan for the purposes of managing development in the Broughton Neighbourhood Area.
This decision was made by Cabinet on 12 December 2018.
Background
On the 17 March 2016, Preston City Council designated Broughton-in-Amounderness Neighbourhood Area for the purpose of preparing a Neighbourhood Plan in accordance with Part Two of the Town and Country Planning (England), Neighbourhood Planning (General) Regulations 2012 (as amended).
Following submission of a Draft Neighbourhood Plan to the Council on 14 March 2017 the plan was publicised and representations were invited under Regulation 16 of the Neighbourhood Planning Regulations.
The statutory 6 week publicity period ended on 12 June 2017, during which time 11 representations had been received.
Preston City Council subsequently appointed an independent examiner: Robert Bryan BA Hons, Dip TP, MRTPI, to consider whether the draft plan met the basic conditions and legal requirements to proceed to referendum, and what modifications, if any, should be made.
The final Plan was submitted on 6 March 2018, following which a final period of publicity, from 7 March 2018 to 18 April 2018 then took place.
The Examiners Report was received on 26 June 2018. The report recommended a number of modifications so that the Plan was able to comply with the basic conditions and concluded by recommending the Plan proceed to referendum.
Decision and Reasons
Adopted Broughton Neighbourhood Plan (PDF, 8 MB) as published for referendum (in this regard, the Neighbourhood Plan that incorporated the Examiner's recommended modifications) meets the basic conditions set out in paragraph 8(2) of Schedule 4B of the Town and Country Planning Act 1990 (as amended), is compatible with European Union obligations and the European Convention of Human Rights and complies with relevant provision made by or under Section 38A and B of the Planning and Compulsory Purchase Act 2004 (as amended).
The referendum which took place on Thursday 18 October decided 'yes'. There was a 44.76% turnout, a total of 87% voted yes for the Neighbourhood Plan. 571 voted 'yes' and 85 voted 'no'.
As the results were over 50% the Council must make the Neighbourhood Plan as soon as reasonably practicable.
The referendum held on 18 October 2018 met the requirements of the Localism Act 2011.
The Council has decided that the Neighbourhood Plan and its preparation does not breach, and would not otherwise be incompatible, with, any European Union obligation or any of the Convention rights (within the meaning of the Human Rights Act 1998).
Preston City Council therefore decided at its meeting on 12 December 2018 to make the Broughton-in-Amounderness Neighbourhood Plan part of the Development Plan for the area.
