Dogs on Leads (Preston City Council) Order 2012

The Dogs on Leads Order 2012 makes it an offence if at any time, on any land to which this order applies you do not keep the dog on a lead of no more than 6 feet in length, unless it is for the exceptions listed below.

The Preston City Council (in this Order called "the Council") hereby makes the following Order:

1. This Order comes into force on 1 January 2013

2. The Order applies to the land specified in the Schedule below.

Offence

3. (1) A person in charge of a dog shall be guilty of an offence if, at any time, on any land to which this Order applies he does not keep the dog on a lead of more than 6 feet in length unless:

(a) he has a reasonable excuse for failing to do so; or

(b) the owner, occupier or other person or authority having control of the land has consented (generally or specifically) to his failing to do so.

(2) For the purpose of this article a person who habitually has a dog in his possession shall be taken to be in charge of the dog at any time unless at that time some other person is in charge of the dog.

Penalty

A person who is guilty of an offence under article 3 shall be liable on summary conviction to a fine not exceeding level 3 on the standard scale

Schedule (description of land to which the Order applies)

This Order applies to all land within the administrative area of the Council and which is:

(i) All recorded vehicular highways (which will include footways, carriageways, cycle tracks and verges within the highway width)

(ii) Miller Park

(iii) The footpaths adjacent to and leading from Avenham Park Pavilion

(iv) Japanese Garden in Avenham Park

(v) Winckley Square Park

(vi) A playground or playing field of a school

(vii) The grounds of Leisure Centres including sports pitches

(viii) A Council owned cemetery or crematorium grounds

(ix) The Peace Garden at the junction of Friargate and Ringway

(x) The Flag Market, Market Place, Preston

(xi) The two Covered Markets

(xii) A designated area within one of the Local Nature Reserves listed below and more particularly defined on the maps attached to this Order: Haslam Park, Grange Valley, Pope Lane, Hills and Hollows, Fishwick Bottoms, Boilton Wood

The 'footpaths adjacent to and leading from Avenham Park Pavilion' being the areas which are shown shaded yellow on the map attached to this order.

The 'Flag Market' being the area flanked by the Harris Museum/Library, Miller Arcade, Crystal House, Cheapside, The Old Post Office, Preston Crown Court (Sessions House)

The 'Covered Markets' being two large roofed structures situated on either side of Earl Street and demarcated by Lancaster Road and Birley Street to the East and Market Street to the West.

'A designated area within a Local Nature Reserve' being an area which is shown shaded yellow on the maps attached to this Order.
